General terms of use for www.talkingp2p.org

This legal notice covers the general terms that govern access and use of the website (http://www.talkingp2p.org), henceforth "the website", owned by talkingp2p with the email address info@talkingp2p.org. Use of the website implies full and exact acceptance of these general terms by the User from the version published whenever the User accesses it, without prejudice to the specific terms which could apply to some of the particular services of the website. Where appropriate, the use of such services will indicate acceptance of the specific terms applicable to them.

The original version of this website is in Spanish. The translation of any section of this site into another language is solely for convenience purposes and is not trustworthy. The User accepts that errors are possible within the translation, and that parts of the website cannot be translated, including this Legal Notice.

Patents, trademarks and copyright of the website contents

Design and logos

The website's structure, design and source code, as well as the logos and trademarks it includes are property of talkingp2p and are protected by trademark and copyright regulations. They cannot be reproduced, modified, distributed, used publicly or, in general, be subject to any other form of exploitation by any means without the prior written consent of talkingp2p.

Common Dispositions

Talkingp2p does not take any responsibility for the use of the contents of the website by third parties and can exercise any appropriate civil or criminal actions in the event of the breach of these rights on the part of the User. The use of this website or any of its material for illegal purposes is completely forbidden.

Use of the portal

Registration and use of talkingp2p.org is free.

Talkingp2p.org provides access to information, services and programmes or data (henceforth "the contents") on the Internet which belong to talkingp2p or to its licencees which the User has access to. Use of the portal is the User's responsibility. This responsibility extends to any registration necessary to access certain services or contents. On registration, the User will be responsible for giving truthful and legal information. On registration, the User will be given a password which he or she will be responsible for using in a diligent and confidential way. The User agrees to make appropriate use of the contents and services (for example, chat, discussion forums, news groups) that talkingp2p offers through its portal and in an enunciative but not restrictive way, to not use them: (i) for activities which are unlawful, illegal or damaging to good faith and law and order; (ii) to spread content or propaganda which is racist, xenophobic, pornographic, in support of terrorism or a threat to human rights; (iii) to cause damage to the physical and logical systems of talkingp2p, their suppliers or third parties, to introduce or spread via the web computer viruses or any other physical or logical systems which are capable of causing the aforementioned damage; to try to access and, where appropriate, use email accounts of other users and to change or interfere with their messages. Talkingp2p reserves the right to remove all comments and contributions which seriously affect respect for a person's dignity, which are discriminatory, xenophobic, racist, pornographic, which are a crime against youths or children, law and order or which according to them, are unsuitable for publication. In any case, talkingp2p will not be responsible for users' opinions given via forums, chat or other tools for sharing.

The User (not talkingp2p.org) is entirely responsible for all content that the User himself downloads, publishes, sends by email, transmits or makes available by any means through talkingp2p.org.
The User understands that he himself must define the limits of privacy and that he alone is responsible for communicating to other users that personal information whose distribution he does not consider harmful. If the User gives personal information to another User, he does so at his own risk.

If the User's email returns messages from other users (eg because the inbox is full), the User's account will be suspended or cancelled.

Each User can register just once on talkingp2.org.

Personal data protection

Talkingp2p is the body responsible for the generated data file with personal information supplied by users of its website. In accordance with the Organic Law of 13th December 15/1999 for the Protection of Personal Information, takingp2p agrees to fulfil its obligation of secrecy with regards to personal information and its duty to treat this information with confidentiality. To this end, it will adopt the necessary means to avoid the altering, loss, handling or uauthorised access to this information. The collection and automated handling of this personal information is for the purposes of management, capability, expansion and improvement of user services, as well as the management of information supplied in user enrolment and authorisation. The user has the right at any time to access, change, cancel or examine the information by writing to info@talkingp2p.org

"Cookies"

The website red.es uses "cookies" (small information files which the website's server sends to the computer of the person accessing the webpage) as the essential way to ensure the correct functioning and displaying of the website for the user. The "cookies" used are temporary and disappear when the user's session ends. "Cookies" are never used to gather personal information.

Cookies will also be used for statistical use of the site and advertising, but only in the unregistered sections of the web.

Changes

With the aim of improving the features of the website, talkingp2p reserves the right, at any time and without prior notification, to unilaterally change, expand or temporarily suspend the capacity, configuration, technical specifications and services of the website. It also reserves the right to change at any time the current conditions of use as well as any other specific conditions.

Liability exemption

Talkingp2p is not responsible for possible typographical, formal or numerical errors contained in the website, or for the accuracy of the information it contains.

Talkingp2p does not accept any responsibility for the exchange of information between users of its website. We particularly do not accept responsibility for underage use of the website since the contents may be damaging to minors.

Unlawful activity notification

In the event that any User or third party considers that any facts or cicumstances reveal the unlawful nature of any activity, access or use of any service or content of the talkingp2p.org website, and, in particular, the infringement of copyright or trademarks, they should notify us by writing to: info@talkingp2p.org

This information will be treated confidentially.

Users are authorised to report a message received from another user if they believe that the Conditions of Service have been violated.

Exemption Rights

Talkingp2p reserves the right to deny or withdraw access to the website and/or to services offered without prior warning, at their request or that of a third party, to those users that Talkingp2p considers have not met with the General Terms of Use.

Hyperlinks contained in the talkingp2p.org website may lead to third party websites. Talkingp2p accepts no responsibility for the content, information or services that might appear in these sites. They are exclusively of an informative nature, and in no way imply any relation between talkingp2p and the people or bodies who own these contents, or own the websites where they are to be found.

Partial Nullity

The declaration that any of the clauses in this Legal Notice is null and void, invalid or ineffectual will not affect the validity or effectiveness of the others, which will continue to be binding. The relinquishment by any section of the fulfilment of any of the General Terms stipulated here does not imply a general relinquishment of another term or terms, nor does it establish a right obtained by the other section.
